NON-RETALIATION POLICY

Workers are reminded that [company name] is committed to obeying all occupational health and safety laws. Making you feel free to come forward and report hazards is an important part of that commitment.
We have thus adopted the following policy to reassure you that you won’t be fired, demoted, reassigned, disciplined or subject to any other punishment for reporting safety and health hazards.
- Obligation to Report. Reporting hazards and violations of [OSHA/State] [OHS] laws and company safety policy is something you not only can but must do. You can report problems to your supervisor, the company safety officer or OSHA/OHS regulatory agency.
- Open-Door Policy. All supervisors and managers are required to keep an open-door policy that fosters trust and encourages workers to report their concerns. Supervisors and managers must take all reports seriously and refer the matter to an appropriate safety officer and/or investigate it themselves.
- Non-Retaliation. To repeat, [company name] will not retaliate in any way against any worker for:
- Reporting a workplace safety and health violation
- Stating a concern about health and safety to the company or OSHA/OHS agency
- Serving on a safety committee or other safety-related project
- Testifying, helping or participating in an investigation, compliance review, proceeding or hearing
- Opposing in good faith any act, procedure or practice he or she thinks is dangerous, illegal or inappropriate under company policy AND/OR
- Engaging in any other activity protected by [OSHA/State] [OHS] laws
- Violators Subject to Discipline. Any person who fails to follow this non-retaliation policy is subject to discipline, up to and including immediate termination for cause.
